w3c compliance is about a professional conduct. It is part of the product, much the same way head-lights are part of a car. Leaving it out on the basis that it wasn’t in the contract could be considered quite slack.

Well if you’re hiring someone to do your design, then I guess you’re right to point out that W3C compliance should be one of your requirements. Sure, it will be a bit harder to do (and will probably cost more), but in the end, having a compliant code is still a good thing to have.
